Sorry,Lindsay! You’re not getting off with probation this time! Lindsay Lohan has said she’d rather go to trial than take a plea deal that involves jail time, and for better or worse, she’s getting her wish. The actress is facing felony grand theft charges involving a $1,200 necklace she “borrowed” a jewelry store that later sold the surveillance tape showing Lindsay walking around the establishment wearing the necklace for $35,000.

Lindsay’s lawyer Shawn Holley had a meeting this afternoon with prosecutor Danette Meyers, who will be handling the actress’s case and wants her to get at least six months if convicted.

The two were unable to make a deal, so Lindsay will have to appear in court tomorrow. Judge Keith Schwartz is expected to hand the case over to Judge Stephanie Sautner for trial. Sautner could violate Lindsay’s probation in her previous DUI case from several years ago and send her back to the slammer one more time.

Of course, she never seems to stay very long, which may be why she never learns from her mistakes.
